§ 6-69. Hours of operation.

  • (a)

    No vendor or licensee under this chapter, except a nightclub and foodstore, shall sell or offer for sale, deliver, serve or permit to be consumed upon the premises of such vendor or licensee any alcoholic beverage between the hours of 1:00 a.m. and 8:00 a.m. on any day of the week, except as allowed for bars and restaurants operating a lounge during permitted extended hours pursuant to section 18-210. The business hours provided for by this subsection also apply to bars and restaurants.

    A nightclub and any other licensee holding a valid city occupational license 5813A will not be permitted to sell, offer for sale, deliver, serve or permit to be consumed upon its premises any alcoholic beverage between the hours of 4:50 a.m. and 8:00 a.m. of any day of the week.

    (d)

    Any other license authorized for the sale of alcoholic beverages for consumption away from the premises which requires a state license of the series APS, such as a foodstore, will be permitted to sell alcoholic beverages for outside consumption at all times when the establishment is open for business, provided the business is not limited to the sale of alcoholic beverages. These establishments will not permit consumption of alcoholic beverages inside or outside the establishment within the property or outside the property in parking, open or public spaces for a distance of 500 linear feet from the entrance to the establishment.

    (e)

    When such consumption is encouraged by the sale of individual cans or bottles or other containers ready for consumption with lids, covers or caps removed or easy to remove by hand or when the licensee fails to request compliance from patrons or to report violations to the police department, the license can be suspended by the licensing administrator who, within ten working days or at the next regularly scheduled city council meeting, whichever occurs first, shall either reinstate the license or seek extended suspension or revocation from the city council for repeated offenses or violations of this chapter.

    (f)

    The police department shall ensure compliance with the hours of operation for establishments selling alcoholic beverages and will report violations to the licensing administrator.
