§ 74-146. Prohibited signs and sign devices.

  • Prohibited signs and sign devices shall be as follows:

    (1)

    Abandoned signs.

    (2)

    Billboards/off-site signs.

    (3)

    Fluttering, spinning or other similar devices except banner signs as provided in section 74-218(6).

    (4)

    Flagpoles exceeding 30 feet in height; two poles shall be permitted for each building. For buildings that exceed 25,000 square feet in floor area, a maximum of four poles may be permitted.

    (5)

    Pole signs.

    (6)

    Portable signs, except such signs attached to or painted on vehicles, not higher than ten feet, including the frame and/or supporting base, from the road surface and not obstructing the view of other vehicular traffic as to create a danger to traffic and pedestrian safety, that are in transit on the roadway within the city. No portable sign may remain stationary for a period of longer than ten minutes. Storage of permitted portable signs shall be within enclosed walls wherein such signs shall not be visible to the public.

    (7)

    Roof signs.

    (8)

    Snipe signs, except legal notices required by law.

    (9)

    Swinging signs.

    (10)

    Signs on public property, unless placed by governmental agencies located on public property for operational or informational purposes.

    (11)

    Signs on utility poles except for utility identification.

    (12)

    Signs that could be confused with traffic signals or traffic signs.

    (13)

    Signs that, in the opinion of the director, constitute a safety hazard.

    (14)

    Any projecting sign extending over a public right-of-way, except that a marquee sign, no less than nine feet in height, and an awning sign, no less than eight feet in height, may be permitted to extend over the pedestrian portion of the right-of-way, no closer than 30 inches to the edge of the curb of the sidewalk.
