§ 90-29. Insurance required.

  • (a)

    Under this article, it shall be unlawful for a licensee to drive or operate or cause or allow another to drive or operate any motor vehicle under the provisions of a certificate unless there is in full force and effect at all times at which such motor vehicle is being operated a liability insurance policy in the sum of $10,000.00 for injury to any one person, $20,000.00 for injuries to more than one person, which injuries are received in the same accident and $5,000.00 for property damage resulting from any one accident; for for-hire vans, public liability insurance shall be in the sum of no less than $10,000.00 per passenger seat or a maximum of $100,000.00 shall be provided by the licensee for the vehicle to be utilized, as provided in this article for each vehicle to be operated. Such liability insurance shall be with a company authorized to do business in the state and shall inure to the benefit of:

    (1)

    Any person who shall receive bodily injuries because of the negligence or misconduct of the licensee or the driver of a motor vehicle while such vehicle is being used under such certificate.

    (2)

    The heirs or legal representatives of any person who shall die because of the negligence or misconduct of the licensee or the driver of a motor vehicle while such vehicle is being used under such license.

    (3)

    Any person who shall sustain damages to his property through the negligence or misconduct of the licensee or the driver of a motor vehicle while such vehicle is being used under such license.

    (b)

    The company writing the insurance shall furnish a certificate of insurance to the city and shall not cancel the insurance without giving 30 days' written notice by registered mail to the city. This insurance certificate shall be placed on file in the office of the police chief.
