§ 90-62. Form and contents of application.

  • (a)

    Every application for a license required by this division shall be in writing verified by the applicant and shall be filed with the licensing section. Such application shall set forth the following:

    (1)

    If the applicant is an individual, the name, age and address of the applicant and the length of time the applicant has resided in the city; if the applicant is a corporation, the name of the corporation and the names and addresses of its officers; if the applicant is an entity or is other than an individual, partnership or corporation, the name of the applicant and the names and addresses of all persons constituting such applicant.

    (2)

    The class of transportation service, whether the operation of one or more sightseeing cars, for-hire cars, for-hire vans or for-hire school vehicles in which the applicant wishes to engage and a brief description of the kind or type of vehicle which the applicant desires to use, including the seating capacity and seating arrangement and the size and gross weight thereof.

    (3)

    The names and addresses of at least three residents of the city, as references.

    (4)

    An agreement by the applicant, if the application should be approved, to file, prior to the issuance of the permit, an insurance policy provided for in section 90-29.

    (5)

    Each application for a license authorizing for-hire van operations shall include a notarized acknowledgement that:

    a.

    The license, if issued, is a temporary permit to meet a temporary need.

    b.

    The license expires 12 months after issue and may not be renewed, except upon approval of a new application therefor.

    c.

    The applicant waives any claims against the city or Miami-Dade County if public transportation facilities, in the opinion of the council, can meet the transportation needs within the city and such licenses are not reissued.

    d.

    The applicant recognizes that the service authorized by the license is not competitive with any transportation services provided by public operators.

    (6)

    Each application for a license authorizing for-hire school vehicle operations shall include a notarized acknowledgment that:

    a.

    The license, if issued, is a temporary permit to meet a temporary need.

    b.

    The license expires 12 months after issue and may not be renewed, except upon approval of the licensing section to continue this class of transportation service in accordance with section 90-68, provided that the city council has declared the need for this service for the current year.

    c.

    The applicant waives any claims against the city or Miami-Dade County if public transportation facilities, in the opinion of the council, can meet the transportation needs within the city and such licenses are not reissued.

    d.

    The applicant recognizes that the service authorized by the license is not competitive with any transportation services provided by public operators.

    (b)

    The following are the items to be required by the licensing section prior to issuing any license and at any on-the-spot inspection:

    (1)

    The city license and sticker on the windshield, which will be placed by licensing section upon issuance of the license.

    (2)

    Approved inspection by the state highway patrol.

    (3)

    The number of passengers authorized, per vehicle.

    (4)

    Chauffeur's registration given by Miami-Dade transportation.

    (5)

    First aid certification by the American Red Cross.

    (6)

    The name, address and phone number, which shall be displayed on the side of the door of the vehicle, and the sign stating "caution transporting children" on the back. Letters must be at least three inches in height.

    (7)

    Certification of the insurance binder made to the city, $10,000.00 per person or a maximum of $100,000.00 per vehicle.

    (8)

    A sticker to be put by the city occupational license inspector after the school bus operator complies with the requirements as set forth in subsections (b)(1) through (7) of this section.

    The licensing section will not perform mechanical inspections of the vehicles.

    (c)

    Every vehicle transporting children to school and any driver-operator must be individually licensed. The license, permit and fee are for only one vehicle and one driver, except when the license is issued to a married couple who have expressed their intention to operate as partners in this business, in which case each one will be authorized to drive the vehicle. Any additional vehicles or drivers will require an occupational license.
