§ 90-100. Revocation consequent upon condition of vehicle.

  • Whenever the police chief shall determine that any motor vehicle for which a permit has been issued pursuant to this division is not in satisfactory mechanical condition or that its general appearance, in the opinion of the police chief, makes it unfit or unsafe for use on the public streets or for the transportation of passengers or that it lacks such appliances attached thereto in good condition as are required by state laws and as required by any section of this Code or city ordinance, the police chief may order such motor vehicle withdrawn from service and the permit therefor revoked unless the certificate holder operating such vehicle shall request a hearing. In such event the police chief may order such motor vehicle withdrawn from service pending such hearing. If it is adjudged at the hearing that the motor vehicle is not in satisfactory mechanical condition as set forth and required by law, the permit may be revoked as to such motor vehicle.
