§ 3.01. Council meeting procedure.

  • (a)

    Meetings. The city council shall hold regular meetings at least twice monthly in each calendar year, at times and places as the city council may prescribe by ordinance. The city council may recess for one month during the calendar year or cancel regular meetings that fall on a holiday or due to the holiday season. Special meetings may be called by the mayor or by at least 4 members of the city council. Written notice of special meetings must be given no less than 24 hours in advance to each councilmember, the mayor and the public, or such shorter time as a majority of the city council deems necessary in the event of an emergency affecting life, safety, health, welfare, property or the public peace.

    (b)

    Rules and minutes. The city council may determine its own procedural rules and order of business and shall keep minutes of its proceedings that shall be open for public inspection. The city council may discipline its members and compel attendance. The city council may expel a member for misconduct in office or neglect of duty, after a duly noticed public hearing, by an affirmative vote of at least 5 councilmembers.

    (c)

    President, vice president. The city council shall elect one of its members as president and another as vice president in the first meeting of November. The city council may remove the council president or vice president by an affirmative vote of at least 4 councilmembers. The president shall preside at the meetings of the city council and in his or her absence; the vice president shall preside. The president shall perform the duties consistent with the office and as otherwise imposed by the city council.

    (d)

    Quorum and voting. Any 4 members of the city council shall constitute a quorum but a smaller number may adjourn from time to time and may compel the attendance of absent councilmembers in a manner and subject to penalties prescribed by the rules of the city council. Voting on resolutions shall be by roll call and recorded in the minutes. Voting on ordinances shall be by roll call for first and second or final reading and recorded in the minutes. If 4 or more councilmembers are ineligible to vote on a particular item because state law requires the councilmembers to abstain from voting, then the remaining members of the city council may vote and approve the item by unanimous vote.
