§ 3-4. Areas of concern.

  • (a)

    Aquifer recharge. The city shall control development that overlays recharge areas with impervious surfaces since impervious areas reduce percolation from rainfall and alter the level of the aquifer and its rate of recharge.

    (b)

    Water contamination. The importance of maintaining the prime recharge capability of the surface area is underscored by the principles of gravity and the fact that significant groundwater contamination often occurs by pollutants carried by stormwater runoff. Accordingly, the city shall enforce to the extent permitted:

    (1)

    Miami-Dade County regulations established for the protection of public potable water wells.

    (2)

    Restrictions for the areas surrounding the Hialeah Wellfield also known as the John E. Preston Wellfield.

    (3)

    Regulations enacted by the city for the protection of potable water.

    (4)

    Chapter 94 of the Hialeah Code, as amended.
