§ 8-4. Concurrency methodology.

  • (a)

    The planning division of the planning and development department, in cooperation with other departments and agencies, shall determine the available, unused capacity of the seven applicable services and evaluate concurrency applications based on the unused or "remaining capacity" of those services. The "remaining capacity" shall mean the unused, uncommitted or surplus capacity of a service that remains available without causing a violation of the level of service standard. Remaining capacity shall take into consideration committed improvements that are to be made to each service and consider commitments or reservations made by the city for previously approved development[s] order or pending applications for development orders.

    (b)

    The methodology includes an identification of service areas or zones reflecting the characteristics of each service. For example, the service area served by a city master pump station constitutes a zone in relationship to the analysis of the sanitary sewer service and the ability of the master pump station to provide service to a proposed project will form the basis for a concurrency determination regarding sanitary sewer service. Zones are defined by the characteristics of the individual service and socioeconomic factors. Concurrency determinations, in some instances, rely on capacity calculations prepared by Miami-Dade County. In those instances, a letter of capacity from the responsible Miami-Dade County agency shall constitute a blanket determination of concurrency for that service sufficient for reliance by the City.

    (c)

    The determination of concurrency shall be based on a consideration of the following criteria:

    (1) Sanitary sewers Capacity of the city master pump stations
    (2) Solid waste Capacity of landfills, incineration facilities, recycling facilities and other disposal facilities
    (3) Drainage Protection from flooding
    (4) Potable water Capacity of the potable water system
    (5) Parks and open space Number and size of each type of open space and park
    (6) Roads Capacity of each primary road, adjusted in accordance with the provisions of the comprehensive plan
    (7) Mass transit Not generally applicable. Frequency of bus trips and proximity to rail lines may be considered toward credit for specific projects only

     

    (d)

    The planning division, in cooperation with other departments, shall incorporate into the analysis the planned and committed improvements to capacity, for each of the seven services. Such improvements shall include the following:

    (1)

    Public facilities that are subject to an enforceable binding agreement.

    (2)

    Public facilities that are funded and scheduled for implementation in the capital improvements element of the Hialeah Comprehensive Plan for construction in the first year (year one) of the city's adopted capital budget or similarly adopted budget of other governmental agencies.

    (3)

    Traffic circulation and mass transit facilities or services, or both, that are scheduled in the capital improvements element of the Hialeah Comprehensive Plan for construction in or before the completion of the third year (year three) of the city's adopted budget or similarly adopted budget of other governmental agencies including the capital budget of Miami-Dade County or the state agency having operational responsibility for affected facilities; in all cases, such facilities must be committed for construction in or before year three.

    (e)

    Other responsible departments and agencies will cooperate with the planning division in the evaluation of the remaining capacity of each public service and provide the planning division with information from which concurrency will be evaluated or with a blanket letter of capacity applicable to all potential development during the next calendar year. Concurrency reviews shall use the following agenda:

    (6) Roads Hialeah Planning Division and Streets Department; where applicable Miami-Dade County and Florida Department of Transportation Analysis of the levels service on the roadway and transit system, including committed improvements by Miami-Dade County and the Florida Department of Transportation
    (7) Mass transit Credit review performed by streets department where applicable
