Upon petition of a property owner or authorized agent or representative, adjustments
and variances to sign regulations as provided by section 74-116 may be granted by the planning and zoning board and use and nonuse variances, conditional
use permits and special use permits may be granted by the city council, upon recommendation
of the planning and zoning board, as provided by the Charter. The planning and zoning
board or the city council may require appropriate covenants and safeguards as a condition
of granting any adjustment, variance, conditional use permit or special use permit.
Violation of such covenants and safeguards shall be deemed a violation of this Code
and enforced in the same manner as other Code violations. Adjustments, variances,
conditional use permits and special use permits run with the land in the absence of
any covenant or condition to the contrary.
