§ 5-2. Stormwater management regulations.

  • (a)

    All developed property, residential and nonresidential, shall pay a stormwater utility fee according to a fee schedule set by the Hialeah City Council.

    (b)

    Management of stormwater quantity and quality within the municipal limits shall be implemented through a Hialeah Comprehensive Stormwater Master Plan. The stormwater master plan, developed in conjunction with the South Florida Water Management District, incorporates state water policy and district stormwater management goals in furtherance of F.S. ch. 403.

    (c)

    The construction of all stormwater management facilities shall be in accordance with state regulations of stormwater discharge provided in F.A.C. 17-25.001 et seq.

    (d)

    All stormwater management facilities constructed within municipal limits shall be approved by the water control section, Miami-Dade County Department of Environmental Resources Management (DERM) and by the appropriate development regulatory agency within city government.

    (e)

    All stormwater management facilities shall be constructed in accordance with the standards and specifications contained in the current edition of the Public Works Manual, Part II, of Miami-Dade County, and Miami-Dade County Code, ch. 24, if applicable.

    (f)

    Preexisting stormwater runoff characteristics of a site shall be preserved to the maximum extent that is practical during construction and afterwards.

    (g)

    All development shall meet stormwater quantity level of service (LOS) requirements in accordance with the current Miami-Dade County/City of Hialeah Stormwater Master Plan. See table 5-1.

    (h)

    (i)

    Stormwater management design shall incorporate best management practices (BMPs) based on the "treatment train" concept depicted in figure 2-15. See table 5-3.

    (j)

    Swales for stormwater runoff retention shall be used for both on-site and public right-of-way drainage to the maximum extent that is practical.

    (k)

    On-site activities, during construction and afterwards, shall not violate any limitations restricting the City of Hialeah pursuant to the issuance of United States Environmental Protection Agency [NPDES (EPA)] Stormwater Discharge Permit No. FLS000023.
